1. Acceptance of Terms

By downloading, installing, or using the AquaHabit mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and AquaHabit ("we," "us," or "our"). Your use of the App is also governed by our Privacy Policy, which is incorporated by reference into these Terms.

2. Service Description

AquaHabit is a gamified habit tracking application that allows users to:

• Create and track personal habits and goals
• Complete focus sessions using timer functionality
• Earn virtual coins through completed activities
• Purchase and customize virtual aquariums using earned coins
• Access productivity tools and habit management features

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time, with or without notice.

3. User Accounts

3.1 Account Creation

To use certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

3.3 Age Requirements

You must be at least 13 years old to use the App. If you are under 18, you represent that you have your parent's or guardian's permission to use the App.

4. User Conduct

You agree not to use the App to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Use the App for any commercial purpose without our consent
• Reverse engineer, decompile, or attempt to extract source code

5. Virtual Items and Coins

5.1 Virtual Currency

AquaHabit uses a virtual currency system called "Coins" that can be earned through completing habits and focus sessions, or purchased through in-app purchases.

5.2 Virtual Aquariums and Items

Coins can be used to purchase virtual aquariums, fish, decorations, and other digital items within the App. These virtual items have no real-world value and cannot be exchanged for real money.

5.3 No Refunds

All purchases of virtual items are final. We do not provide refunds for virtual currency or items, except as required by applicable law.

5.4 Loss of Virtual Items

We are not responsible for the loss of virtual items due to account termination, technical issues, or device changes.

6. Intellectual Property

6.1 Our Rights

The App and all its content, features, and functionality are owned by AquaHabit and are protected by copyright, trademark, and other intellectual property laws.

6.2 Your Rights

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial use.

6.3 User Content

You retain ownership of any content you create within the App, but you grant us a license to use, display, and distribute such content as necessary to provide the App's functionality.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information when you use the App.

By using the App, you consent to the collection and use of your information as described in our Privacy Policy.

8. Termination

8.1 Termination by You

You may stop using the App at any time by deleting it from your device.

8.2 Termination by Us

We may suspend or terminate your access to the App at any time, with or without cause, including if you violate these Terms.

8.3 Effect of Termination

Upon termination, your right to use the App will cease immediately, and you may lose access to your account and any virtual items.

9. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to:

• Warranties of merchantability and fitness for a particular purpose
• Warranties that the App will be error-free or uninterrupted
• Warranties regarding the accuracy or reliability of information

10. Limitation of Liability

To the maximum extent permitted by law, AquaHabit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or use
• Business interruption
• Personal injury or property damage

Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you have paid us in the 12 months preceding the claim.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the App
• Sending notifications through the App
• Updating the "Last Updated" date above

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.
